CONDITIONAL PARTICIPATION AGREEMENT FOR THE HARTSVILLE COMMUNITY GARDEN

The Hartsville
Community Garden (HCG) is dedicated to bringing Hartsville's citizens together; increasing our community’s access to
healthy food and healthy gardening practices; promoting mutual respect for our neighbors and our surrounding neighborhoods;
and enhancing community pride, purpose, and values. All participating organizations
and gardeners are required to read, understand and sign this Participation Agreement before working at the HCG. Good gardening to all Participants!
HGC PARTICIPATION AGREEMENT
As a condition
to my/our participation in the HCG, I have read and understand the following:
1. PARTICIPATION FEE. Payment
of an un-refundable Participation Fee of $ _______ to help cover HCG's operating expenses.
2. WAIVER. As a condition to
my HCG participation, I have read, understand and agree to be fully bound by the CGC Waiver, Release and Hold Harmless Agreement
set forth below.
3. HCG HOURS. I
understand that the HGC operating hours are dawn to dusk.
4. CHILDREN/PETS. Children
are welcome in the HCG provided they are both accompanied and supervised by an adult at all times. Pets are not allowed in the HCG under any circumstances.
5. HCG PLOTS. I understand
all plots in HCG are assigned on a "first come, first serve" basis and I will be fully responsible for the HCG gate key (including
replacement cost) assigned to me, and fully responsible for the maintenance and upkeep of the plot assigned to me, including
watering, weeding, harvesting and other related maintenance. I will not alter
the dimensions of my assigned plot without permission from the HCG Committee. I
will respect the boundaries of the plots of others.
6. HCG CITIZENSHIP. I
agree to: Keep HCG's gates closed at all times; Lock the HCG's gate when
I exit HCG; Be responsible for supplying my own gardening supplies and tools; Keep my own plants and tools within my plot;
ensure that plants or weeds from my plot do not invade neighboring plots or the aisles; and Prevent my plants from growing
so tall as to inhibit shade and/or growth on the plots of others. I also agree to participate in HCG's fall cleanup and volunteer
toward HCG's community gardening efforts.
7. PROHIBITED CONDUCT.
I will not use fertilizers, insecticides or weed repellents that may affect the plots of others and I will not remove
any tools, plants, crops or anything else from others’ plots without their permission.
8. WATER CONSERVATION. To
conserve water, I agree to mulch my plot with leaves, straw, grass clippings, etc., and use drought resistant varieties whenever
possible; and I will remain on or near my plot while watering it.
9. HOUSEKEEPING. I will keep
all paths and plots free of trash, grass, weeds, etc; and box, bag and otherwise remove all trash from my plot and its surroundings
from HCG's premises.
10. HARVESTNG & SELLING PRODUCE. I
know that all produce should be harvested when ripe and ready. If I fail to timely
harvest my plot, I authorize the HCG Committee to harvest it and dispose of it in any way they may choose. I understand I am permitted to harvest and sell any produce from my plot at the Good Living Marketplace
without having to pay a vendor's fee and that I may keep all proceeds.
11. HCG PLOT ABANDONMENT. If for any
reason I decide to abandon my plot, I will promptly notify the HCG Committee. Otherwise,
I authorize the HCG Committee to determine that my plot has been abandoned for inactivity and take it over and/or reassign
it to another participant.
12. TERMINATION OF PARTICIPATION. I
understand and agree that the HGC Committee has full discretion to determine whether any violation of any of the foregoing
conditions has occurred and full discretion to issue a warning or to terminate this Participation Agreement without any refund.

BY SIGNING BELOW, I AND/OR THE
AFORESAID ORGANIZATION, AFFIRM THAT:
1. I Have Read, Understand And Agree, For Myself
And The Said Organization I Represent, To Comply With All The Community Garden Rules And Regulations.
2. I Agree, For Myself And The Said Organization
I Represent, To Protect And Hold The City Of Hartsville, The Property Owner Where The Community Garden Exists, And The Community
Garden Committee, Harmless From Any Responsibility, Personal Liability, Claim, Loss Or Damage, Including Vandalism, That May
Arise From The Use Of The Garden By Me, Members Of The Said Organization, Or Our Guests.
3. I Agree, For Myself And The Said Organization
I Represent, To Assume All Risks Of Injury, Harm Or Loss While On The Said Property Where The Community Garden Exists, As
A Participant Or Otherwise, And To Waive Any And All Such Claims As May Arise Against The Hartsville Family YMCA, City Of
Hartsville, The Property Owner Where The Community Garden Exists, And The Community Garden Committee.
4. I Assume, For Myself And The Said Organization I
Represent, Full Responsibility For Any Space Allocated To And Utilized By Me Or The Said Organization I Represent.
5. I Accept, For Myself And The Said Organization I
Represent, Full Responsibility For The Quality And Condition Of Any Products Offered And Sold By Me, Or The Said Organization I
Represent, To The Public, Whether On The Premises Or Elsewhere, Including The Good Living Marketplace.
6. Basically states… Garden At Your Own Risk.
